COMPLETE RULES AND DETAILS OF THE GALLERY OF LIVING HISTORY SCHOOLS
COMPETITION: MAKING HISTORY! (“Competition”)
(1) Please read the following terms and conditions (“Terms”) carefully. By entering or
participating in this Competition, entrants, team co-ordinators and parents/guardians agree to
be bound by these Terms.
(2) Privacy Notice: All information collected in connection with this Competition will be
treated in accordance with section 8 of the Terms and the Gallery of Living History’s
Privacy Policy, accessible at [LINK TO PRIVACY POLICY].
1. THE COMPETITION AND THE GALLERY OF LIVING HISTORY
1.1 This Competition is being organised and operated by The Gallery of Living History Limited,
with its registered office at Olympus House, Olympus Avenue, Leamington Spa,
Warwickshire, United Kingdom, CV34 6BF, registered with company number 13424170
(“GOLH”).
1.2 GOLH is a not-for-profit organisation which aims to bring to life the truth, its context and the
incredible stories within our history for the benefit of the future of society by encouraging each
of us to be time explorers and constantly to review our history, to tell the stories of the unsung
and to celebrate their achievements alongside those who are already being celebrated.
1.3 The Competition requires teams of participants aged 11 to 16 to work together to design a
statue that celebrates and commemorates an unsung person or people, living or dead, whose
heroic story has never been properly told. The winning entry will be created and memorialised
on a plinth, unveiled in Spring 2022, as part of the Coventry City of Culture celebrations. Two
runners up will be shown virtually on screens, on the side of the plinth.
1.4 The Competition is being conducted through GOLH’s own website: [LINK].
2. ELIGIBILITY
2.1 The Competition is open to all secondary schools and youth centres located in the West
Midlands. The West Midlands is limited to locations within the following postcodes: ST –
Stoke; TF – Telford; WS – Walsall; WV – Wolverhampton; DY – Dudley; B – Birmingham; NN
– Northampton; WR – Worcester; HR – Hereford.
2.2 Each secondary school or youth centre may enter a maximum of three teams.
2.3 Entrants in each team must be aged between 11 – 16 years old upon date of entry to the
Competition. Each team must have a minimum of three entrants . There is no maximum team
size, and teams may be made up of students of different ages. The organisers reserve the
right to limit the maximum number that may make up a team for reasons of safety or
accommodation.
2.4 All entrants must be able to attend a workshop for Competition finalists on Saturday 27
November on Coventry University campus. Details such as location and timings will be
confirmed with Competition finalists separately. GOLH shall not be liable for any
accommodation, travel or other costs incurred by the entrants.
2.5 All entrants aged 11 – 16 years old must have parental/guardian consent to enter this
Competition and their parent or guardian must agree to these Terms for themselves
and on behalf of the entrant. By entering the Competition, each entrant confirms that
(a) they have obtained such consent; and
(b) they agree to be bound by these Terms.

2.6 Each team must be supervised and co-ordinated by a teacher or adult youth worker at each
secondary school or youth centre (the “Team Coordinator”). The Team Coordinator shall be
responsible for ensuring that each entrant has the permission of their parent or guardian to
enter the Competition and for registering the team and submitting each team’s entry to GOLH.
2.7 The following individuals are not eligible to enter the Competition:
(a) employees of GOLH;
(b) employees of agents or suppliers of GOLH, who are professionally connected with the
Competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
3. HOW TO ENTER
3.1 The Competition starts at 00:01 on Monday 6 September, 2021 (the “Opening Date”). The
Team Coordinator must register each team via the GOLH website by Friday 24 September
(the “Registration Deadline”), entering the name of the school or youth centre together with
names and dates of birth of each entrant and any such other information as indicated on the
[registration form]. All submissions must be sent by the Team Coordinator to [INSERT EMAIL
info@golh.co.uk] by 23:59 Tuesday 2 November (the “Closing Date”). Finalists will be invited
to attend a compulsory workshop day on Saturday 27 November, with final submissions due
at 23:59 on Friday 14 January (the “Final Submission Date”). GOLH reserves the right to
extend the Registration Deadline, Closing Date, and Final Submission Date by way of
publication on its website, [LINK].
3.2 To enter the Competition, teams must choose a person or people, living or dead, whose
heroic story has never been properly told and submit a statement in writing, audio, or video
that sets out:
(i) WHO the team has chosen and WHY the team feels this person or group needs to be
recognised, together with some details of the person or group’s achievements;
(ii) WHO might oppose the team’s suggestion and WHAT these objectors might say against
the memorialisation; and
(iii) HOW the team would convince those who oppose the memorialisation that this is the right
person or group to the celebrated.
(iv) the full name and dates (if the person or people are no longer living)
3.3 The written, audio, or video submission should be accompanied by rough plans, sketches,
drawings, or photo-shop designs (for example, CAD drawings) that the team feels helps to
explain and visualise the team’s ideas and what the statue could look like. Teams may be as
creative as they wish with the design, as this does not have to just recreate that person or
group’s true physical likeness – teams can, for example, use objects that represent the
person or group, or what they stood or stand for.
3.4 A written submission must be 1,000 words or less. A video must be three minutes or less in
length and must be in .mov file format.
3.5 All entries must be received by GOLH by no later than 23:59 on the Closing Date. All entries
received after the Closing Date are automatically disqualified.
3.6 No purchase of any product or service is required to enter the Competition.
3.7 Teams shall submit one (1) entry only. GOLH reserves the right to refuse entry to the
Competition to any team who submits or attempts to submit more than one (1) entry.

3.8 Entries will not be valid where they are made online using methods generated by a script,
macro or the use of automated devices. GOLH reserves the right to verify the validity of entries
and to exclude entries it believes have been made using any automated entry techniques.
3.9 GOLH accepts no responsibility for entries that are incorrectly completed, lost, delayed or
which are not received for any reason.
3.10 A computer and internet access is required to enter this Competition. It is the responsibility of
the entrants to ensure permission is obtained from the owner of the computer and the
individual who pays for the internet service. No refund may be claimed for expenses related to
the use of an internet connection for the purpose of participating in this Competition.
4. JUDGES AND PRIZES
4.1 Judges, who have been nominated by GOLH, (the “Judges”), will decide the finalists and
winning entries. A full list of the Judges is available at [WEBSITE LINK], and will be available
after the Closing Date for a period of thirty (30) days. In addition, GOLH will send the full
names of the Judges to anyone who writes within one (1) month after the Closing Date of the
Competition requesting details of the Judges and who encloses a self-addressed envelope to
GOLH’s address at [Gallery of Living History, Making History Competition, Olympus House,
Olympus Avenue, Leamington Spa, Warwickshire, United Kingdom, CV34 6BF].
4.2 The decision of the Judges nominated by GOLH is final and no correspondence or discussion
will be entered into.
4.3 There will be three (3) prizes awarded in total (‘Prize’ or ‘Prizes’).
4.4 The winning statue design will be replicated and built by a professional foundry for display on
a specially designed plinth by GOLH and its affiliates at any such locations as GOLH or its
affiliates may decide in their absolute discretion from time to time. The plinth and the winning
statute will be unveiled by the founder GOLH, Andy Serkis, in Spring 2022 (the “Unveiling
Date”) (hereafter, the ‘Prize’).
4.5 The entries of two (2) runners up will be shown virtually on screens, on or near the side of the
plinth.
4.6 The Prize will remain on the plinth for one (1) year from the Unveiling Date. Thereafter, GOLH
will, within a reasonable period and as mutually agreed between GOLH and the winning team,
arrange for the winning statue to be delivered to the school or youth club of the winning team.
4.7 Each Prize is subject to availability and GOLH reserves the right to substitute the Prize for
another prize of equal value should the specified Prize become unavailable for any reason
outside of GOLH’s control.
4.8 Each Prize is non-negotiable, non-transferable, non-divisible and may not be exchanged for
any cash or other alternative and is not permitted to be sold or resold, or offered for sale by
the winner and is not for use in conjunction with any other Competition or offer. Prizes cannot
be replaced or refunded in the event of loss, theft or missed opportunity.
4.9 For the avoidance of doubt, except as explicitly set out in this section 4 (Judges and Prizes),
all costs associated with a Prize, including without limitation, taxes and tariffs, insurance, and
anything related to the Prize not specifically included and outlined in the description of the
Prizes above or on GOLH’s website will be borne solely by the winning team.
5. WINNERS
5.1 The Judges will decide the winning entry by [January 31 2022]. GOLH shall have the absolute
discretion to extend or change such date from time to time as it sees fit.

5.2 GOLH will contact the winning team via the Team Coordinator as soon as practicable after the
Judges’ decision and in any event within fourteen (14) days, using the telephone number or
email address provided with the Competition entry.
5.3 Each Prize winner or finalist will have three (3) working days from the date and time the
notification was sent to claim the Prize or place at the workshop day for Competition finalists
by replying in the way required in the notification. This may include requiring the winner to
prove eligibility, including, without limitation, proof of age.
5.4 If the Prize winner (or later substitute winner) does not respond within seven (7) days, GOLH
reserves the right to disqualify the winner and select a substitute winner at its sole discretion.
5.5 It is the responsibility of the winner to provide any required documentation and satisfy any
other legal requirements for receiving the Prize, including any documentation required by law
and/or GOLH. Prize winners may be required to sign and return any documents and releases
reasonably requested by GOLH prior to receiving the Prize.
5.6 GOLH must either publish or make available information that indicates that a valid award took
place. To comply with this obligation, GOLH will publish the name of the school or youth club
of the finalists and of the winning team and the winning submission on its website, and to
anyone who emails [EMAIL ADDRESS info@golh.co.uk] or writes to [Gallery of Living History,
Making History Competition, Olympus House, Olympus Avenue, Leamington Spa,
Warwickshire, United Kingdom, CV34 6BF] (enclosing a self-addressed envelope) within one
(1) month after the Closing Date of the Competition.
5.7 If you object to any of the name of your school and winning submission being published or
made available, please contact GOLH at [EMAIL ADDRESSinfo@golh.co.uk]. In such
circumstances, GOLH must still provide the information and winning entry to competent
authorities (including, for the United Kingdom, the Advertising Standard Authority) on request.
5.8 Unsuccessful teams will not be notified.
6. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
6.1 All Competition entries and any accompanying material submitted to GOLH will become the
property of GOLH on receipt and will not be returned.
6.2 By submitting your Competition entry and any accompanying material, you agree to:
(a) assign to GOLH all your intellectual property rights with full title guarantee; and
(b) waive all moral rights,
in and to your Competition entry, all derivative works, and otherwise arising in connection with
your entry to which you may now or at any time in the future be entitled under the Copyright,
Designs and Patents Act 1988 as amended from time to time and under all similar legislation
from time to time in force anywhere in the world.
6.3 You agree that GOLH may, but is not required to, make your entry available on its website
[WEBSITE LINK] and in any other media or format, physical or digital, whether now known or
invented in the future, for any purpose and in connection with any publicity of the Competition
without compensation, restriction on use, attribution or liability. Participants agree not to
assert any moral rights in relation to such use where the moral rights in respect of the content
are theirs to assert. You agree to grant GOLH an exclusive, royalty free, worldwide,
irrevocable, sub-licensable right to use, to use, display, publish, transmit, copy, edit, alter,
adapt, modify, store, re-format, publish and display, for any purpose in any media or format
whether now known or invented in the future, for the full period of any intellectual property
rights in the Competition entry and any accompanying materials. Participants agree not to
assert any moral rights in relation to such use where the moral rights in respect of the content
are theirs to assert.

7. LIMITATION OF LIABILITY
7.1 Without prejudice to an entrant’s statutory rights and, to the extent permitted by applicable
law, GOLH, its agents or distributors will not be responsible or liable to compensate the
winner or accept any liability for any loss, damage, personal injury or death occurring as a
result of taking up a Prize.
7.2 GOLH is not responsible for any problems or technical malfunction of any computer online
systems, servers or providers, computer equipment, software failure or any email or entry to
be received on account of technical problems or traffic congestion on the internet, telephone
lines or at any website or any delay or failure of any postal or equivalent delivery service or
any combination thereof, including injury or damage to the entrant’s or any other person’s
computer or mobile telephone related to or resulting from participation in the Competition.
Nothing in these Terms shall exclude GOLH’s liability for fraudulent misrepresentation, death
or personal injury as a result of negligence or any other liability that cannot be excluded or
restricted by law.
8. DATA PROTECTION
8.1 GOLH will collect and process personal information about the Competition entrants, including
the names and dates of birth of each entrant and any such other information provided to
GOLH within the registration form, the written, audio and/or video submission or at any other
time during the course of the Competition, such as proof of age documentation which may be
provided at the workshop day for Competition finalists or otherwise.
8.2 Personal information provided by entrants will only be used by GOLH for the purposes of
conducting the Competition, on the basis that it has a legitimate interest in managing and
administering the Competition, ensuring that the Competition is run fairly and contacting the
Competition winners.
8.3 GOLH may request to use the names, audio and/or video entries of winners to promote future
similar competitions and the aims and ideals of GOLH generally, but will only do so with
parental/guardian consent. Otherwise, GOLH will securely delete all personal information
collected in connection with the Competition within one (1) year from the Unveiling Date.
8.4 All personal information collected in connection with the Competition will be treated in
accordance with the Gallery of Living History’s Privacy Policy, accessible at [LINK TO
PRIVACY POLICY], which provides information about individuals’ rights under applicable data
protection laws.
9. OTHER GENERAL TERMS
9.1 Events may occur that render the Competition itself or the awarding of any Prize impossible
due to reasons beyond GOLH’s control and accordingly, GOLH may, at its absolute
discretion, vary or amend the Competition.
9.2 GOLH reserves the right in its reasonable discretion to disqualify entrants that do not comply
with these Terms or the spirit of them or any entrant who it reasonably believes has interfered
with the fair running of the Competition. For the purposes of clarity the discretion may be used
to disqualify an entrant and ‘entrant’ means team and individual within a team. GOLH
reserves the right to refuse entry of any individual and/or team to the Competition or future
events organised by GOLH:
(a) where an entrant has been disqualified from any Competition held by GOLH within
twelve (12) months of the Opening Date;
(b) where GOLH reasonably believe such individual has not complied with these Terms;
and/or
(c) where such individual is ineligible to participate in the Competition (or if participation
in the Competition should have been refused for any reason whatsoever).

9.3 For the avoidance of doubt, all times and dates set out in these Terms refer to the times and
dates in United Kingdom. In the event of any dispute over the time or date of any entry
submitted, the decision of GOLH shall be final.
9.4 These Terms are governed by the law of England and Wales, and any disputes (contractual
or non-contractual) are subject to the exclusive jurisdiction of the courts of England and
Wales. If you are a consumer, you will benefit from any mandatory provisions of the law of the
country in which you are resident.
9.5 It is advised that all entrants retain a copy of these Terms for future reference.
GALLERY OF LIVING HISTORY PRIVACY POLICY
1. WHO WE ARE
We are The Gallery of Living History Limited, with our registered office at Olympus House, Olympus
Avenue, Leamington Spa, Warwickshire, United Kingdom, CV34 6BF, registered with company number
13424170 (“GOLH”, “we”, “us, “our”).
GOLH is a not-for-profit organisation which aims to bring to life the truth, its context and the incredible
stories within our history for the benefit of the future of society by encouraging each of us to be time
explorers and constantly to review our history, to tell the stories of the unsung and to celebrate their
achievements alongside those who are already being celebrated. GOLH aims to explain these stories
and provide accessible learning spaces that engage and encourage curiosity and debate while
entertaining through a variety of immersive and interactive experiences, including a multimedia
interactive statue and sculpture park and destination, immersive exhibitions, installations and live
performances, film screenings/talks, education laboratory, seminars/webinars, augmented reality tours
and guides and digital multi-channel access to the archives (the “GOLH Services”).
This Privacy Policy sets out how we collect and process any personal data we hold about you, including
information we collect from you, or that you provide to us, through our website or any data you may
provide when you contact us, register for competitions, sign up to our mailing list or otherwise take part
in or receive the GOLH Services.
GOLH is a controller for the purpose of the Data Protection Act 2018 and the UK General Data
Protection Regulation.

Our legal basis for processing your personal data that you provide to us on our website or otherwise
through your use of the GOLH Services, is to provide you with the GOLH Services requested, including

discuss the GOLH Services with you where requested and manage our relationship with you
(including to notify you about changes to our terms or Privacy Policy); and
administer any competitions you decide to take part in.
If you fail to provide us with such personal data, we may not be able to provide you with the GOLH
Services.

us, including information about new events, exhibitions and other GOLH Services. Our legal basis for

When you use our website, details of your visits including, but not limited to, traffic data, location data,
preferences and the resources that you access are collected automatically. This is statistical data about
users’ browsing actions and patterns. We may also collect information about the device you use to

Our legal basis for processing the personal data included in the information related to your visits to our
website is that it’s necessary for our legitimate interests to:
improve our website and the GOLH Services; and
administer and protect our organisation and the website (including troubleshooting, data

4. SHARING YOUR DATA
We may share your personal data in the following ways:
our employees and/or volunteers may have access to your personal data for the purposes of
assisting us with organising and providing you with the GOLH Services;
our third party service providers or partners (such as such as workshop or competitions facilitators,
email marketing service providers, payment providers and cloud storage providers) may have
access to your personal data when providing services on our behalf; and
if all of the assets (or substantially all of them) which GOLH uses to operate are acquired by a third
party, we may transfer your personal data we then hold to that party so that the acquirer can
continue to provide the GOLH Services.

We have put in place appropriate security measures to prevent your personal data from being
accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit
access to your personal data to those employees, volunteers and other third parties who have a need
to know and are subject to a duty of confidentiality.
We have put in place procedures to deal with any personal data breaches and will notify you and any
applicable regulator of a breach where we are legally required to do so.

partnered with to help provide the GOLH Services.

7. RETENTION
We hold your personal data for as long as necessary to provide you with the GOLH Services or to
otherwise administer our relationship with you and usually for six years thereafter.
To determine the appropriate retention period, we consider the amount, nature and sensitivity of the
personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the
purposes for which we process your personal data and whether we can achieve those purposes
through other means, and the applicable legal, regulatory, tax, accounting or other requirements.
We may retain your personal data for a longer period in the event of a complaint or if we reasonably
believe there is a prospect of litigation in respect to our relationship with you.
